Article 1 - Meetings
Section 1: The Executive Council
The Executive council will meet: each school month or at the call of the president or at the request of three members of the Council.
Section 2: The General Assembly
The General Assembly will meet at least twice a school year in accordance with the calendar prepared by the Executive Council and approved by the Assembly at the last meeting of the previous school year or no later than the first general meeting of the present school year.
Section 3: Quorum
A. The General Assembly
A quorum for the General Assembly will be 25 percent of the paid active membership.
B. Proxy Votes
Proxy votes will account as a part of the quorum necessary for the discussion and/or vote on the specific issue for which the votes are to be cast, provided that the issue has been officially published beforehand and provided that no amendment to the issue has been passed by the present assembly. Proxy votes may not serve as a part of the quorum for the other matters of business.
C. Executive Council and Committees
A majority will serve as a quorum for the Executive Council and committee meetings. |
Section 4: Announcement of Meetings
The president will issue a written notice including an agenda of all General Assembly meetings at least seven days prior to the meeting date. Executive Council and committee meetings will require at least a three-day notice to all members eligible to attend. At no time will the meeting time and place be kept secret from members of the Federation.
Article 2 - Duties and Powers of Officers
Section 1: The President
The president shall preside over meetings of the General Assembly and the Executive Council, appoint the chairs and members of standing committees, appoint special committees, be ex-officio members of all standing committees, co-chair the grievance committee, prepare a list of current committees and assignments and present it to the last General Assembly meeting, and shall be the executive officer of the Federation except when it employs an executive secretary. The president shall represent the Federation before the public either personally or through delegates, and shall perform all functions usually attributed to this office both at state and local levels.
Section 2: Vice-President
The vice-president of the Federation shall perform the functions usually attributed to this office. He/She shall work closely with one or more standing committees as the president might suggest. The vice-president will assume responsibility for our "local" convention arrangements including obtaining nominees to serve as delegates. The vice-president shall serve as parliamentarian and rule on matters of parliamentary procedure at Executive Council and General Assembly meetings.
Section 3: Recorder
The recorder shall keep accurate minutes of all meetings of the Executive Council and General Assembly and shall maintain official files.
Section 4: Correspondent
The correspondent shall issue all notices, shall answer all correspondence at the direction of the president, and shall report all outside correspondence to the president and the Executive Council. The correspondent shall be the custodian of the seal and charter of the Federation.
Section 5: Treasurer
The treasurer shall be bonded and shall hold the funds of the, Federation and disburse them upon authorization by the Executive Council. The treasurer shall supervise the membership committee, shall keep accurate accounts of receipts and disbursements, and shall report to each meeting of the General Assembly and Executive Council. The treasurer shall prepare and present to the Executive Council with the aid of a committee, if the president deems necessary, budget recommendations no later than 30 days prior to the last annual meeting of the General Assembly. The treasurer shall publish in May an annual financial statement to be distributed to all members as directed by the Executive Council.
Article 3 - The Executive Council
Section 1: Duties
The Executive Council will present before or at the first general meeting of the Assembly for its approval, a calendar of General Assembly meetings to be held in that school year and a list of committee assignments. The Executive Council will publish seven days in advance, the agenda for a General Assembly. The Executive Council will present before or at the last general meeting of the General Assembly for its approval, budget recommendations including dues necessary for the implementation of the budget.
Section 2: Powers
Executive Council may appropriate funds in accordance with the budget, may approve the payment of all legal debts, may ratify committee appointments, and may replace council members who, in the opinion of the council, are either incapacitated or grossly negligent in the performance of their duties. The Executive Council may dispense all unfinished business presented at a General Assembly unless otherwise specified by the Assembly and may act on-all business listed on the agenda for a General Assembly that fails to establish a quorum.
Section 3: Limitations
The Executive Council may at not time amend the constitution or the bylaws or ratify contracts.
Article 4 - Elections
Section 1: Terms of Office
A. President, vice-president, recorder, correspondent and treasurer shall be elected by the members for a one-year term.
B. Any or all officers may be reelected each year by the members for successive one-year terms.
C. Representatives on the Executive Council shall be elected for terms of two years on a staggered basis with at least one-half of the representatives being elected on alternating years. |
Section 2: General Elections
A nominating committee will be appointed by the president and ratified by the Executive Council no later than March 1. The nominating committee will publish a list of willing candidates, at least two, for every office open for election.\
Elections committee appointed by the president and ratified by the Executive Council will conduct the general election either at the General Assembly or by mail as the Executive Council prescribes within 60 days prior to May 15.
A. Elections by the General Assembly
Elections by the General Assembly may take place no sooner than seven days after the list of candidates is published by the nominating committee. Nominations from the floor of the Assembly are acceptable. Proxy votes for the election of officers and representatives at the General Assembly must by signed by the voter and presented in a sealed envelope to the president or delegated authority before the meeting is called to order.
B. Elections by Mail
Elections by mail may take place no sooner than 30 days after the publication of candidates by the nominating committee. Additional nominations may be accepted upon receipt of a petition signed by 10 percent of the membership including the name of the nominee within 15 days after the date of publication. The nominating committee will then publish a revised list of candidates and election will begin no sooner than seven days after the publication of the revised list. Ballots must be returned to the elections committee within seven days after the election commences and ballots will be opened and counted in the presence of the Executive Council within five days after the completion of the balloting. All ballots must be presented in a sealed envelope, and placed inside another sealed envelope, which bears the signature of the voter.
C. Pluralities and Ties
A simple majority of votes cast is sufficient for election. If no candidate for a given term receives a majority of votes cast, the candidates with the two largest pluralities will compete in a run-off election to be held immediately following the announcement of the balloting in the General Assembly or within 15 days if the ballots were taken by mail. If no majority is earned in the run-off election, the candidate with the largest plurality will be declared the winner. If a tie occurs between two candidates in either the initial election or run-off election, a flip of the coin will determine the winner. |
Section 3: Vacancies
If at any time the membership increases to a level, which warrants an additional representative, or a position on the Executive Council is declared vacant, the president may activate a nominating committee to choose at least two willing candidates for each position. No member of the Executive Council may serve on the nominating committee. If a General Assembly does not meet within 30 days after the announcement of candidates by the nominating committee, the Executive Council may elect a candidate for the vacancy from the list submitted by the nominating committee. The winner of the election will serve until the completion of the next general election.
Section 4: Continuous Terms
If the general election of any or all officers on the Executive Council is not complete by May 15, the existing officers and representatives will remain in their respective positions in an active capacity until such time as the elections have been completed.
Section 5: Installation of officers
The officers shall be installed at the regular membership meeting in May or at a special meeting or banquet held for this purpose.
Article 5 - Committees
Section 1 The following standing committees shall be active in this Federation:
A. The Administrative Policy Committee
The administrative policy committee will consist of not less-than three nor more than five members to serve a term of one year. The administrative policy committee will study new or revised administrative policies, will consult with the administration on the interpretation of existing policy, will cooperate with the
negotiations committee on gathering data on contract proposed resolutions submitted by members in the General Assembly or by the Executive Council.
The committee will be responsible for a representative to attend all public meetings of the Moraine Park Technical College District Board. The committee will report at least bimonthly to the Executive Council and at least once a year to the General Assembly.
B. The Negotiations Committee
The negotiations committee will consist of up to five members. The committee will be appointed by the president within 60 days after the signing of each contract. The committee will, therefore, be on going, allowing for preparation and research for upcoming negotiations. The committee will negotiate, present and interpret the contract.
C. The Grievance Committee
The grievance committee will consist of up to five members, including the chair and the president as co-chair. The committee will assist in processing grievances according to the contract.
D. The Workload Committee
The workload committee will consist of two members to work with the District on workload issues.
E. The Legislative Committee
The legislative committee will consist of a minimum of three and no more that five members for a staggered term of two years. The legislative committee will study the current and past activities of local, state, and national legislative and political bodies and will periodically make recommendations for Federation consideration and adoption and will publish periodically throughout the year, summaries on current legislative progress in matters on education.
F. The Public Relations Committee
The public relations committee will consist of three members to serve a term of one year. The public relations committee is responsible for the dissemination of information relative to faculty and Federation activities to District news media, and through four (4) annual newsletters, intra-district publications. The officers of the Federation shall be responsible for said publications in the case of vacancies on this committee. |
Section 2
The following special committees shall be appointed:
A. Nomination Committee
B. Elections Committee
C. Membership Committee
D. Other committees as necessary |
Section 3
Chairs of each of the standing committees and of all special committees shall be appointed by the president with the approval of a majority of the other elected officers.
Section 4
Members of each committee shall be appointed by the chair with majority approval of the Executive Council.
Article 6 - Amendment to the Bylaws
Section 1
These bylaws may be amended by majority vote at any regular meeting of the General Assembly provided that the proposed amendments have been studied by the Executive Council and that copies of the proposed amendments have been sent to the membership at least two calendar weeks in advance of the meeting.
Article 7 - Budget Year
The budget year of this Federation will commence on July 1 and continue for
a year's time thereafter or until such time as the Assembly approves a subsequent
budget.
Article 8 - Financial Matters
Section 1
Dues changes shall be passed on directly to the membership at the time of their
assessment from the national and/or state organization. |
